These Terms of Service (“Terms”) govern your use of The Wedding Missy website, online store, digital products, creative services, vendor services, consultations, and any other services we provide.
By accessing our website, purchasing a product, booking a service, submitting an enquiry, or otherwise engaging with The Wedding Missy, you agree to these Terms.
If you do not agree with these Terms, please do not use our website or purchase our products or services.
1. ABOUT THE WEDDING MISSY
The Wedding Missy provides creative products and professional services for couples, wedding professionals, and businesses within the wedding industry.
Our products and services may include:
- Digital wedding stationery and templates;
- Wedding invitations and stationery suites;
- Editable Canva templates;
- Wedding planning resources and digital downloads;
- Custom wedding stationery and design;
- Branding and creative design;
- Content creation;
- Marketing strategy;
- Brand strategy and positioning;
- Creative direction;
- Photography and creative services;
- Vendor marketing and promotional services;
- Business and marketing consulting;
- Wedding vendor retainers;
- Partnerships and collaborations;
- Other creative, branding, marketing, or consulting services described on our website or agreed with a client.
Different products and services may be subject to additional terms, specifications, proposals, quotations, invoices, or agreements.
Where a separate written agreement has been entered into between The Wedding Missy and a client, that agreement will apply to the specific services covered by it.
2. DEFINITIONS
For these Terms:
“The Wedding Missy”, “we”, “us” or “our” means The Wedding Missy and its owners, contractors, employees, collaborators, or authorised representatives.
“You”, “your” or “customer” means any person or business accessing our website, purchasing our products, or using our services.
“Couple” means a customer purchasing wedding-related products or services for their own wedding or event.
“Vendor” means a wedding professional, business, venue, supplier, creative professional, planner, photographer, florist, stylist, or other wedding-industry business engaging with The Wedding Missy.
“Digital Product” means any downloadable, editable, digital, or electronically delivered product sold through our website.
“Services” means any creative, design, branding, marketing, content, strategy, consulting, photography, or other professional service provided by The Wedding Missy.
3. USING OUR WEBSITE
You agree to use our website lawfully and responsibly.
You must not:
- Use our website for fraudulent or unlawful purposes;
- Attempt to gain unauthorised access to our systems;
- Copy, reproduce, scrape, distribute, or commercially exploit our website content without permission;
- Interfere with the operation or security of our website;
- Upload malicious software or harmful material;
- Misrepresent your identity or relationship with a business;
- Use our products or services to infringe another person's intellectual property rights;
- Reproduce, resell, or redistribute our digital products without permission.
We reserve the right to suspend or restrict access to our website or services where we reasonably believe these Terms have been breached.
4. DIGITAL PRODUCTS
Our digital products are supplied electronically and may include templates, stationery, invitations, planning tools, artwork, documents, graphics, and other downloadable files.
Digital products are supplied according to the description displayed on the relevant product page at the time of purchase.
You are responsible for checking the product description, specifications, compatibility requirements, included files, and editing requirements before purchasing.
Where a product requires third-party software or platforms, such as Canva, you are responsible for having access to the required platform and complying with that platform's own terms.
We do not guarantee that a third-party platform will remain available, unchanged, or compatible with our products indefinitely.
5. DIGITAL PRODUCT LICENCE
Unless otherwise stated, purchasing a digital product from The Wedding Missy gives you a limited, non-exclusive, non-transferable licence to use the product for your personal wedding or the specific permitted purpose stated in the product listing.
You may:
- Download the files provided;
- Edit the files where editing is permitted;
- Print the design for your own wedding or event;
- Share the finished design with vendors involved in producing your wedding materials.
You may not, unless we have given you written permission:
- Resell the digital product;
- Redistribute or share the original template or editable files;
- Upload the files to websites, marketplaces, template libraries, or file-sharing services;
- Give the files to another person for their own separate event;
- Claim our designs as your own;
- Use our templates to create products for resale;
- Reproduce or commercially exploit our underlying designs.
Purchasing a digital product does not transfer ownership of the underlying intellectual property to you.
6. CUSTOM DESIGN SERVICES
Where you purchase a custom design service, the scope of work, deliverables, revisions, timeline, fees, and other requirements may be agreed through a proposal, quotation, email, invoice, or separate service agreement.
Custom work may include, for example:
- Invitations;
- Stationery suites;
- Signage;
- Wedding branding;
- Logos;
- Monograms;
- Digital assets;
- Printed design materials;
- Other bespoke creative work.
The scope of a custom project is limited to the deliverables agreed between you and The Wedding Missy.
Additional requests outside the agreed scope may incur additional fees.
7. REVISIONS AND CLIENT FEEDBACK
Where revisions are included in a service package, the number of included revisions will be stated in the relevant proposal, package, or agreement.
You agree to provide clear and timely feedback.
Delays in receiving information, approvals, content, images, or feedback from you may affect the project timeline.
We are not responsible for delays caused by circumstances outside our reasonable control or by a client's failure to provide the information or approvals required to complete the work.
8. VENDOR SERVICES
The Wedding Missy may provide professional services specifically for wedding vendors and businesses.
These may include:
- Marketing strategy;
- Brand strategy;
- Branding;
- Brand positioning;
- Content strategy;
- Content creation;
- Creative direction;
- Photography and creative production;
- Campaign development;
- Creative design;
- Marketing consulting;
- Business strategy;
- Vendor visibility and promotional services;
- Partnerships and collaborations;
- Other creative or marketing services agreed with the Vendor.
The exact services provided to a Vendor will depend on the package, proposal, quotation, retainer, or agreement entered into between the Vendor and The Wedding Missy.
A Vendor may not assume that services outside the agreed scope are included.
9. VENDOR RETAINERS
Where a Vendor engages The Wedding Missy on a monthly or ongoing retainer:
- The retainer fee, payment date, services, deliverables, and expected working hours will be agreed before work begins;
- The retainer covers the agreed scope of services and does not automatically include unlimited work or revisions;
- Unused hours or deliverables do not automatically roll over into a subsequent month unless agreed in writing;
- Additional work outside the agreed scope may be charged separately;
- Third-party costs, advertising spend, software subscriptions, printing, production, travel, photography, videography, influencers, or other external expenses are not included unless specifically stated.
The retainer relationship may be terminated according to the notice period stated in the relevant agreement.
If no notice period has been specified, either party may request termination by giving 30 days' written notice.
Any outstanding invoices remain payable following termination.
10. VENDOR RESPONSIBILITIES
Vendors engaging our services agree to provide accurate and timely information, materials, approvals, access credentials, images, copy, pricing, availability, and other information reasonably required to perform the services.
The Vendor is responsible for ensuring that all materials supplied to The Wedding Missy are accurate and that they have the necessary rights and permissions to use those materials.
We are not responsible for errors resulting from inaccurate, incomplete, outdated, or unauthorised information supplied by a Vendor.
11. MARKETING AND CREATIVE RESULTS
Marketing, branding, content, creative, and strategy services involve factors outside our control.
While we will use reasonable professional skill and care, we do not guarantee specific business outcomes, including:
- A specific number of enquiries;
- A specific number of bookings;
- A specific level of revenue;
- Viral content;
- Search rankings;
- Marketing reach;
- Advertising performance;
- Return on investment;
- A particular level of business growth.
Results may be affected by market conditions, pricing, competition, audience behaviour, platform algorithms, seasonality, client responsiveness, advertising budgets, and many other factors.
12. THIRD-PARTY PLATFORMS
Our products and services may use or interact with third-party platforms, including but not limited to Canva, Shopify, Instagram, Facebook, Pinterest, Google, email platforms, payment processors, hosting providers, and other software.
We do not control these third-party platforms and are not responsible for:
- Changes to their functionality;
- Platform outages;
- Account suspensions;
- Changes to their policies;
- Loss of access;
- Technical failures;
- Changes to algorithms or distribution;
- Third-party fees.
Your use of third-party platforms remains subject to their own terms and policies.
13. PAYMENTS
All prices are displayed in the currency stated on the relevant product or service page unless otherwise agreed.
For digital products, payment must be completed before the product is made available.
For custom services and vendor services, payment terms will be stated in the relevant invoice, proposal, package, or agreement.
Where a deposit or upfront payment is required, work may not begin until the required payment has been received.
You agree to provide accurate billing and payment information.
We reserve the right to suspend services where an invoice remains unpaid.
14. TAXES AND ADDITIONAL COSTS
You are responsible for any taxes, duties, bank charges, currency conversion fees, or other charges that may apply to your purchase or service engagement, unless otherwise required by applicable law or expressly included in the stated price.
15. REFUNDS AND CANCELLATIONS
Digital products are generally non-refundable once they have been accessed or downloaded, subject to applicable consumer law.
Our Returns & Refund Policy forms part of these Terms.
For custom services and vendor services, cancellation and refund arrangements will depend on the applicable service agreement, proposal, invoice, and applicable law.
Where applicable law provides a consumer with a mandatory right to cancel, refund, repair, replacement, price reduction, or other remedy, nothing in these Terms removes that right.
16. INTELLECTUAL PROPERTY
All intellectual property belonging to The Wedding Missy remains the property of The Wedding Missy unless expressly transferred in writing.
This includes, but is not limited to:
- Designs;
- Templates;
- Graphics;
- Illustrations;
- Branding concepts;
- Photography;
- Written content;
- Website content;
- Copywriting;
- Marketing materials;
- Strategies;
- Processes;
- Concepts;
- Original artwork;
- Digital products;
- The Wedding Missy name, logo, branding, and visual identity.
Purchasing a product or service does not automatically transfer ownership of our intellectual property.
Where custom work is created for a client, ownership and usage rights will be determined by the applicable proposal, invoice, service agreement, or written agreement.
17. CLIENT MATERIALS
You retain ownership of materials you provide to us, including your own:
- Logos;
- Photographs;
- Brand assets;
- Written content;
- Business information;
- Personal information;
- Other materials supplied for a project.
By providing materials to us, you grant The Wedding Missy permission to use them to the extent reasonably necessary to provide the agreed services.
You confirm that you have the necessary rights and permissions to provide those materials to us.
18. PORTFOLIO AND PROMOTIONAL USE
Unless otherwise agreed in writing, The Wedding Missy may display completed work created for a client in our portfolio, website, social media, marketing materials, case studies, or other promotional channels.
For vendor clients, this may include displaying the vendor's business name, logo, publicly available images, and completed creative work.
If a project contains confidential information or must remain private until a specified date, please notify us in writing before work begins.
We will respect reasonable confidentiality requirements agreed between the parties.
19. CLIENT CONFIDENTIALITY
Where a client provides confidential business information to The Wedding Missy, we will use reasonable care to keep that information confidential and use it only for purposes connected with the agreed services.
This does not apply to information that:
- Is publicly available;
- Was already lawfully known to us;
- Becomes publicly available without our breach;
- Is independently developed;
- We are legally required to disclose.
Where a separate confidentiality or non-disclosure agreement exists, that agreement will govern the relevant confidential information.
20. CONTENT AND INFORMATION ON OUR WEBSITE
We make reasonable efforts to ensure that information on our website is accurate and up to date.
However, we do not guarantee that every description, image, price, availability statement, or other information will always be complete, accurate, or current.
We reserve the right to correct errors, update information, modify products, discontinue products, or change pricing at any time.
Changes will not affect orders that have already been accepted except where required by law.
21. NO PROFESSIONAL ADVICE
Unless expressly stated otherwise, our content, templates, guides, consultations, and recommendations are provided for general creative, organisational, branding, or marketing purposes.
They do not constitute legal, financial, tax, accounting, immigration, medical, or other regulated professional advice.
You should obtain appropriate professional advice where necessary.
22. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, The Wedding Missy will not be responsible for indirect, incidental, special, consequential, or unforeseeable losses arising from your use of our website, digital products, or services.
We are not responsible for losses caused by circumstances outside our reasonable control, including third-party platform failures, internet outages, technical problems, changes to social media or other digital platforms, or events beyond our reasonable control.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
Where legally permitted, our total liability in relation to a specific purchase or service engagement will not exceed the amount you paid to The Wedding Missy for that specific product or service.
23. EVENTS OUTSIDE OUR CONTROL
We will not be responsible for failure or delay in performing our obligations where that failure or delay results from circumstances beyond our reasonable control.
These circumstances may include natural disasters, war, civil unrest, government action, power outages, internet or technology failures, illness, strikes, platform outages, or other circumstances that could not reasonably have been prevented.
We will make reasonable efforts to communicate with affected clients and resume services as soon as reasonably possible.
24. SUSPENSION OR TERMINATION
We may suspend or terminate access to our services where:
- You materially breach these Terms;
- You fail to make required payments;
- You engage in abusive, fraudulent, threatening, or unlawful behaviour;
- You misuse our intellectual property;
- Continuing the relationship would create an unreasonable legal, financial, or operational risk.
Termination does not remove any payment obligations that arose before termination.
25. DISPUTES
If you have a concern or dispute, we encourage you to contact us first so that we can attempt to resolve the matter fairly and reasonably.
Nothing in these Terms prevents a consumer from exercising any mandatory rights or remedies available under applicable consumer protection law.
26. GOVERNING LAW
These Terms are governed by the laws applicable to The Wedding Missy's business, except where mandatory consumer protection laws provide otherwise.
Where you are a consumer, you may also have rights under the mandatory laws of the country in which you live that cannot be excluded by contract.
27. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, products, services, technology, or legal requirements.
The updated version will be posted on this website with a new “Last updated” date.
Your continued use of our website after an updated version has been published constitutes acceptance of the updated Terms to the extent permitted by law.
28. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified or removed only to the extent necessary.
The remaining provisions will continue to apply.
29. ENTIRE AGREEMENT
These Terms, together with any applicable product description, order confirmation, Returns & Refund Policy, Privacy Policy, proposal, quotation, invoice, or separate service agreement, constitute the agreement between you and The Wedding Missy regarding the relevant purchase or service.
Where there is a conflict between these Terms and a separately signed service agreement, the separately signed agreement will take precedence for the services specifically covered by that agreement.
